DMCA Policy for Elite Dubai Stays (hotels.bdnewslife.com)

Elite Dubai Stays (“we,” “us,” or “our”) respects the intellectual property rights of others and is committed to complying with the provisions of the Digital Millennium Copyright Act (DMCA). This policy outlines our procedures for receiving and processing notices of alleged copyright infringement in accordance with 17 U.S.C. § 512.
1. Official DMCA Designated Agent
All notifications of claimed infringement should be submitted in writing to our designated Copyright Agent:

Note: Only DMCA notices should be sent to this agent. All other inquiries (such as questions about VIP table prices or luxury car rental) should be directed to the general contact email found on our Contact Us page.
2. Infringement Notification (Notice and Takedown)
If you believe that any content on hotels.bdnewslife.com infringes upon your copyright, you must provide the Designated Agent with a written communication containing substantially the following information:
A. Required Elements of the Notification
- Physical or Electronic Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the Copyrighted Work: Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
- Identification of the Infringing Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., the URL link).
- Contact Information: Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address.
- Statement of Good Faith Belief: A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Statement of Accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
B. Review and Action
Upon receipt of a valid and complete DMCA notice, we will expeditiously remove or disable access to the material claimed to be infringing. We will then take reasonable steps to notify the user who posted the allegedly infringing material (the “Subscriber”).
3. Counter-Notification Procedure
If a Subscriber believes that material was wrongly removed or disabled, the Subscriber may submit a counter-notification to the Designated Agent.
A. Required Elements of the Counter-Notification
- Physical or Electronic Signature: The physical or electronic signature of the Subscriber.
- Identification of Material: Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled.
- Statement Under Penalty of Perjury: A statement under penalty of perjury that the Subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Consent to Jurisdiction: The Subscriber’s name, address, and telephone number, and a statement that the Subscriber consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located (or if the Subscriber’s address is outside of the U.S., that the Subscriber consents to jurisdiction of any judicial district in which the service provider may be found), and that the Subscriber will accept service of process from the person who provided notification of the alleged infringement.
B. Review and Restoration
Upon receipt of a counter-notification, we will promptly forward a copy to the original complaining party. If the complaining party does not inform us within 10-14 business days that they have filed an action seeking a court order to restrain the Subscriber from engaging in infringing activity, we may replace the removed material or cease disabling access to it.
4. Repeat Infringers Policy
In accordance with the DMCA, Elite Dubai Stays reserves the right to terminate, under appropriate circumstances, the account or access rights of any user who is determined to be a repeat infringer of copyrights.
